The issue of unitary executive theory is in the end moot. Starting with Marbury v. Madison, and progressing through the activist justices of today, SCOTUS has basically given itself the power to legislate, destroying the system of checks and balances that the Founding Fathers created.

Beyond any issues specific to Alito, what this nation needs is a court of strict constructionists, perhaps even anti-federalists (I'll start with Antonin Scalia and the ghosts of Patrick Henry, William Rehnquist, and Thomas Jefferson). We need to realize that the powers of the federal government ought to be severely limited, and in fact is severely limited by the Constitution.
